Back in 2009 50 Cent filed a lawsuit against Worldstarhiphop.com for copyright infringement for using a masthead on the site that included his image. 50 believed the site was promoting his image on a site that displayed negative content. He even went ahead and claimed that he temporarily shut the site down. Last Monday a judge ruled in favor of the rapper’s claims of copyright and right of publicity claims. WSHH tried to use the defense of fair use but the judge ruled “Defendants provide no authority to support the fair use of a celebrity’s image or likeness. This is not surprising, as a celebrity’s image, standing alone only provokes that celebrity’s persona.
